1. Acceptance of Terms

Your access to and use of the Muted Social (“Muted”) applications and websites, currently located at https://muted.com (collectively the “Muted Site”) is subject to these Terms and Conditions and all applicable laws. Use of the Muted Site and related Services is also subject to our Privacy Policy, incorporated herein by reference.

By accessing and browsing the Muted Site, you accept, without limitation or qualification, these Terms and Conditions and the Privacy Policy, and acknowledge that any other agreements between you and Muted are superseded and of no force or effect.

2. Muted Site Policy

• NSFW media are currently not accepted on Muted.
• Actions that attempt to circumvent the platform’s terms and policies will not be tolerated and may result in account suspension or ban.
• Users who violate these policies may receive a strike against their account; accounts with multiple strikes may be banned.
• Please use your own judgment to distinguish between good-faith, reasonable discussions and attempts to circumvent the rules.
• Muted will have the final say in moderation for the benefit of the community and will continue to update policies as the platform grows.

3. Intellectual Property

The Muted Site and all User Generated Content (including commentary, images, third-party links, and similar content) are copyrighted unless otherwise noted and are the property of Muted and/or the individuals who created any individual piece of content (the “Creator”). No such materials may be copied, reproduced, republished, modified, or used in any way except as provided in these Terms.

All trade names, trademarks, and images and biographical information contained in the Muted Site are either the property of, or used with permission by, Muted. Any unauthorized use may violate copyright, trademark, and other proprietary rights, as well as laws of privacy and publicity.

4. Permitted Use

The Muted Site and all content are maintained for your personal entertainment and information. No material may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy on any single computer for your personal, non-commercial home use only, provided you keep intact all copyright and other proprietary notices.

Modification or use of content for any other purpose is a violation of the copyright and proprietary rights of Muted and the Creators. You may not republish, distribute, modify, transmit, or use content for public or commercial purposes without express written permission from Muted and the applicable Creator(s).

5. Accuracy & Security

While Muted uses reasonable efforts to include accurate and up-to-date information, Muted makes no warranties or representations as to accuracy and assumes no liability for errors or omissions.

Muted shall use commercially reasonable efforts to restrict unauthorized access to data and files. However, no system can be entirely impenetrable. You acknowledge that unauthorized third-party access may be possible. Use of the Muted Site and Services is at your own risk.

6. Community Guidelines & Conduct

Your use of the Muted Site and Services shall be governed by Muted’s Community Guidelines. Muted reserves the right to take disciplinary measures including deleting or altering usernames, suspending or terminating accounts, and revoking any license granted, for any reason and at its sole discretion.

a) Unacceptable Online Conduct

You agree that you will not violate any applicable law in connection with your use of the Muted Site, nor will you interrupt or attempt to interrupt its operation, including but not limited to:

1. Using unauthorized third-party software to intercept or collect information from the Services;
2. Modifying or causing files that are part of the Muted Site to be modified;
3. Creating or maintaining unauthorized connections to the Site or unauthorized scraping of images/content without the Creator’s express written permission;
4. Using the Site for promoting or advertising third-party goods and/or services; or
5. Disrupting or assisting in the disruption of any computer used to support the Site or another user’s access.

7. Username Rules

Muted may change, block, remove, suspend, or terminate your username and/or avatar if it determines, at its sole discretion, that your username is contrary to the Community Guidelines. You may not use any name that:

1. Belongs to another person with the intent to impersonate or mislead;
2. Uses vulgar, insulting, offensive, defamatory, obscene, hateful, or discriminatory language;
3. Belongs to any celebrity, media personality, or popular culture persona, or is protected by third-party trademarks or publicity rights;
4. Is, contains, or is substantially similar to a third-party trademark or service mark;
5. Is related to drugs, sex, alcohol, or criminal activity; and/or
6. Muted otherwise finds offensive or inappropriate.

8. Rules Related to UGC & Services

If you download or access the Site or any content and breach these terms, or use content in a manner Muted deems inappropriate (including promoting offensive, harmful, unlawful, harassing, abusive, pornographic, or discriminatory acts), or initiate chargebacks without first pursuing support channels, your account may be immediately terminated or suspended at Muted’s sole discretion.

Refunds will not be issued for accounts in violation of these Terms and Conditions.

9. Privacy & Data Transfer

Muted will not intentionally disclose personally identifying information to third parties, except where necessary to comply with the law or enforce these Terms. By using the Site you signify acceptance of Muted’s Privacy Policy.

The Site and Services are operated on servers in various jurisdictions, including the United States. By accessing the Site, you consent to the transfer of personal information outside your country. Muted ensures personal information is protected to the same standard globally and maintains appropriate data protection contracts with third-party service providers.

10. DMCA Notice

Muted respects intellectual property rights and will remove infringing content pursuant to 17 U.S.C. §512. Repeat infringers may have their accounts terminated. To file a DMCA complaint, provide the following in writing:

1. An electronic or physical signature of a person authorized to act on behalf of the copyright owner;
2. Identification of the copyrighted work claimed to be infringed;
3. Identification of the infringing material and its location on the Service;
4. Contact information reasonably sufficient to reach you;
5. A good-faith belief statement that the use is not authorized; and
6. A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the owner.

11. Disclaimer & Limitation of Liability

The applicable jurisdiction may not allow the exclusion of implied warranties. Some of the above exclusions may not apply to you.

12. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any principles of conflicts of law. If any provision is unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity of the remaining provisions.

13. Changes to Terms

These Terms and Conditions may be revised from time to time by updating this posting. You are bound by any such revisions and should periodically visit this page to review the then-current Terms.
